Shop auction - Terms of purchase

Curio srl is mandated to sell objects consigned in name and on behalf of the owners, acting exclusively in accordance with the consignor to deliver the agreed amount for the object. The effects of the sale pertain exclusively to the relationship between Seller and Buyer, without any further responsibility on Curio srl in addition to those derived from the received mandate.

The Buyer can reserve online the purchase of the offered object, using the option Reserve Now which will directly put the person in contact with the Curio srl staff who are responsible for defining payment and shipping agreements.

To the final price of a single lot, the Buyer will have to pay a commission to Curio srl of 24.50%, including VAT, on the final price, up to 100,000 euro, and 21.50% for any excess.

The reservation on the object is subject to prior registration by the customer, who must fill out a form with personal details and include a valid identification document.  The client is then given a username and password, which allow for reservations.  The computer system automatically creates an email confirmation of the booking.  Subsequently, Curio srl staff will make contact with the customer to provide all necessary information for the completion of the purchase procedure of the reserved object.

For more information on the condition and quality of the objects, you are able to view them, by appointment, at the offices of Curio srl.  In this circumstance, it will also be possible to speak directly with our experts who are availability for any clarification and to explain any errors that may be present in the information on the object.  It will also be possible to request a Condition Report through the information of each piece for sale or with an email request, to have more information on the conservation state. 

Each object in the Asta Shop comes with an information sheet in which there is a detailed description of the object and its conservation state.  The titles of the metals and the weights of the precious gems are approximate, unless otherwise indicated.  The reported gemological elements should be considered as personal opinions of the gemologist, formulated without removing the gems from their frames; except for those accompanied by gemological analysis issued by gemological laboratories accredited by the Chamber of Commerce, or other public bodies

In the information for the watches, there is the title of the metals, the brand, the condition and any visible defects.  Curio srl is not liable for any hidden defects, or the replacement of parts or mechanisms.

Curio srl reserves the right to withdraw any lot from a sale.

Curio srl, after the purchase confirmation, will issue an invoice on which the fee details and agreed extra exchanges will be detailed.

The Buyer has seven days to complete the purchase.  The purchased and paid objects must be promptly collected from the Curio srl offices in Florence, Lungarno Amerigo Vespucci 6/R or, upon the request of the purchaser, by courier with costs borne by the purchaser.  The dates of delivery by shipment will be agreed between the parties according to the time needed to send the object from Curio srl to the address provided by the buyer.

Curio srl accepts payments only by the purchaser of the invoice in the following ways:

-In cash: payments in cash can be made up to Euro 999,99 in accordance with the Law

In the event that the Buyer nominates a third person to collect the already paid lots, the latter person must have a mandate, a copy of the identification document of the person delegating and the payment receipt.

Everything paid and purchased must be immediately collected.  Curio srl is exonerated from any responsibility in relation to the custodian and eventual deterioration of and objects and, furthermore, reserves the possibility to charge a weekend storage cost of euro 20,00.

Curio srl allows, in all appropriate offices, the collection of the accrued auction house charges which have been awarded online and not withdrawn.

Any complaints or notices of withdrawal of the purchase must be communicated by writing a registered letter to A/R a Curio srl, Lungarno Amerigo Vespucci 6/R, Florence. The notice of withdrawal must also be sent in advance by email to info@curiofirenze.com. The right of withdrawal will be exercisable within fourteen days from the date of the physical acquisition of the object by the consumer (Decr. Leg. 21 February 2014, n. 21 - dir.2011/83/UE, art. 52). In the event of a complaint about the veracity of the materials and of the signature of the purchased object, the purchaser must substantiate this claim with a report written by an approved expert in the subject.  Opinions by unqualified persons will not be taken into consideration.  Curio srl reserves the right to open a debate with a qualified expert elected by the auction house and a qualified expert appointed by the purchaser. A claim recognized by Curio srl will result in the return of the price paid.  The shipping charges for returning the item to Curio srl will be borne by the buyer.  In case of withdrawal, reimbursement by Curio srl will take place after the return to their

In the case of a direct/purchase of works of art, buyers are required to comply with all of the laws and regulations in relation to the objects, subject to notification, with particular reference to L. n. 1089 del 1 June 1939. The export of the objects/works is regulated by legislation, customs laws and tax regulations.  Curio srl disclaims any liability to any purchaser with regard to any restrictions on export of the sold lots.  The purchaser shall not, in the case of exercising the right of refusal by the state, demand refund or compensation from Curio srl or the Seller. 

The Legislative Decree of 22 January 2004 regulates the export of Cultura Goods outside the territory of the Italian Republic, which exports outside the European Union are also subject to rules provided by the EC Regulation n. 3911/92, 9 December 1992, as modified by the EC Regulation n. 2469/96, 16 December 1996 and of the EC Regulation n. 974/01, 14 May 2001. Curio srl is non liable for the release of foreseen relevant permits, not can they guarantee release.  The failure to grant such permits does not justify the cancellation of the purchase or non-payment.

The cost of providing the necessary export documents and/or licenses (Attestato di Libera Circolazione) is the responsibility of the purchaser.

These Purchase Conditions are automatically accepted by the auction participants within the Auction Shop or the Curio srl office.  Any disputes are under the jurisdiction of the Court of Florence.
